In order to ensure the consistent and accurate application of NAFTA preferential duty rates, the rules dictate that importers need to obtain new blanket North American Free Trade Agreement certificates of origin every 12 months. The North American Free Trade Agreement (NAFTA) is a preferential tariff program. Some imports may qualify for a lower rate of duty under the North America Free Trade Agreement (NAFTA).
If so, a valid NAFTA Certificate of Origin must be completed and signed by the supplier and accompany the customs documents. Shipments without a valid NAFTA Certificate of Origin will be assessed the full rate of duty.
It is against Customs regulations to claim NAFTA duty rates when a valid NAFTA certificate is not available at the time of import. The Administrative Monetary Penalty System (AMPS) has significant fines that can be assessed for using an incorrect tariff treatment or for the failure to have a valid certificate on hand at the time of import.
To ensure that you are protected against customs assessed penalties, Near North, will not apply NAFTA tariff treatment on your imported goods unless we have received a valid NAFTA Certificate of Origin at the time of import.
If we do not have a valid blanket NAFTA Certificate of Origin on file for your imported good or if a NAFTA Certificate does not accompany your imported product, we will fax you a request.
